These Terms and Conditions govern your membership in LeadPhysician and the use of the LeadPhysician website, the “Website”. In addition to these Terms and Conditions you are advised to read our Privacy Policy, which also is part of this agreement.

By using or accessing the Website and partaking in any of our research projects, you agree to be bound by these provisions. If you do not agree to these Terms and Conditions, you may not access or otherwise use the Website, partake in any of our research projects nor take advantage of your panel membership.

The Panel and the Website are managed and maintained by LeadPhysician.

The Website and all data related to the Website are hosted in the United Kingdom. The information held on our web servers and our panel member database is treated with the utmost care and consideration in regards to your privacy, see also our Privacy Policy.

Any communication or material sent to LeadPhysician shall be treated as non confidential and non proprietary, with exception of any personal information covered by our Privacy Policy. LeadPhysician has the right to use your ideas, concepts or know-how or techniques contained in any communication for any purpose without compensation.

Membership to LeadPhysician is free.

Panel members can only join the panel once and therefore membership is personal to you and is not transferable to any other person. LeadPhysician has the right to refuse any membership applications.

To register with LeadPhysician, you will be asked to provide information on key profiling demographics that we at a minimum need to ensure you are eligible to become a member of LeadPhysician and to ensure that once you have successfully registered to the panel you have every opportunity to be invited to our surveys. By submitting your application to become a panel member, you agree to LeadPhysician holding, storing and processing your personal data.

As part of this agreement, you are responsible to ensure that your personal details and your profile data at any point are true, accurate and up to date. Providing additional information as part of your profile, accessible on your personal member pages, further increase your chances of being invited to studies specifically relevant to you. Details on how we protect your personal and profile data can be found in our Privacy Policy, which is also part of this agreement.

It remains the panel members' responsibility to ensure their login credentials (e-mail and password) are kept safe. LeadPhysician will not be liable for any unauthorised use of your account, which includes unauthorised use of your email address and password.

As part of your membership of LeadPhysician, you are entitled to honoraria for successful participation in our studies. The value of your honorarium, communicated to you prior to study participation, is dependent on multiple factors, ranging from, for example, the length of the study to the complexity of the research project.

Honoraria are payable by means of the honoraria preference selected by you in your personal member page. LeadPhysician reserves the right to substitute any honoraria for a reward of equivalent value or higher value if a reward is not available for an unacceptable amount of time.

LeadPhysician reserves the right to appoint third party honoraria providers to administer our Honoraria Program. When using third party providers, LeadPhysician takes every care reasonable to ensure your privacy is protected. For more details on how your privacy is protected also see our Privacy Policy.

LeadPhysician takes all reasonable measure to ensure honoraria payments are made to you within 1 to 6 weeks after completion of the study, depending on your honoraria preference. You are responsible to notify LeadPhysician within 6 months of completion of a study of any honoraria not paid. Failing to do so may further delay your honorarium payment. LeadPhysician shall not be liable for any losses suffered due to any errors in the administration of honoraria due to incorrect honoraria address details available on your personal member account.

LeadPhysician reserves the right to revert your honoraria in case this has not been claimed for a period of 11 months and the official expiration term has not been passed yet. Any unclaimed and reverted honoraria will be reissued without delay upon the intended recipients request. It is the recipients responsibility to keep track of their honoraria payments and redemption.

You are responsible to declare any taxes, if due, to your local financial authorities. LeadPhysician will not be liable for this nor provide your local financial authority with any details on your behalf. Details on any honoraria paid to you can be found on your personal member pages, under the Honoraria History section.

LeadPhysician reserves the right to quarantine or cancel your honoraria due if it suspects foul play or intentional breach of any of the clauses set out in our Terms and Conditions.

You may access and use the Website solely pursuant to these Terms and Conditions for your personal and non-commercial use. Any use contrary to these Terms and Conditions requires the prior written consent of LeadPhysician.

You may access the Website anonymously as a visitor, and will not be required to provide personal information. However, in order to access certain services and contents on the Website, such as studies, you are required to register as a member of LeadPhysician.

Any software that may be downloaded from a website operated by LeadPhysician is the responsibility of that third party. LeadPhysician does not accept any liability for loss or damages caused by viruses or otherwise arising as a result of you downloading such software.

The information on the Website is for information purposes only and therefore LeadPhysician accepts no liability for the accuracy or completeness of the information contained therein.

The views and opinions expressed on the website are not necessarily those of LeadPhysician.

You may not use spiders, robots or other automated data mining technique to catalogue, download, store or otherwise reproduce or distribute content available on the Website or to manipulate the results of any activity carried out on the Website including, but not limited to, studies.

You may not take any action to interfere with the Website or any other user's use of it. You may not send unsolicited emails, including promotions or advertisements, through the Website.

You may not forge or hide your true identity in any postings or emails.

You may not post on the Website any material which is threatening, libellous, defamatory, and obscene or could otherwise violate any law. LeadPhysician will fully cooperate with any law authorities or court order requesting or directing the disclosure of the identity of anyone who posts such material.

You may not frame portions of the Website within any other website, alter the appearance of the Website or establish links from any other website to the Website other than to the home page.

All pages and content within or linking to the Website including, but not limited to, text, graphics, audio, video, photographs, studies & study content and logos are the intellectual property of or are authorised for use by LeadPhysician and its licensors, partners and affiliates.

Except as expressly permitted by these Terms and Conditions or by LeadPhysician in writing, you may not copy, reproduce, modify, republish, display, upload, post transmit or distribute in any way any content of the Website.

The Website may contain links to other websites not maintained by LeadPhysician and information about products and services offered by third parties.

If any third party websites are linked to or from the LeadPhysician website, this does not mean that LeadPhysician endorses or has any responsibility for the site in question or anything which appears on it. You should read the terms and conditions of any such website you visit.

Information contained on the Website is intended for general information purposes only. LeadPhysician accepts no liability for the accuracy or completeness of information contained on the Website.

The information, products and services on the Website are subject to change at any time, without notice and liability.

If you no longer wish to be a member of LeadPhysician, you may request to be removed from the panel.

You can request your personal details to be removed from LeadPhysician by:

• accessing the ‘remove me’ link in each e-mail received from us
• accessing your personal members pages and selecting to be removed
• sending us an e-mail from the e-mail address you registered with and with the words 'Remove Me' in the subject line
• sending us an e-mail stating the e-mail address with which you registered with LeadPhysician and your request to be removed in the subject line, as above

Failure to follow the stated procedure correctly may result in delay in the removal of your information.

Removal request will be dealt with promptly. However there may be a gap of up to 1 month between your request to be removed and the cessation of the receipt of any further e-mails from LeadPhysician.

Upon termination of your account, you forfeit any right to any honoraria not yet reimbursed to you.

LeadPhysician reserves the right to suspend or cancel panel membership, and therewith any outstanding honoraria payments, by notifying you by email if one of the following events occurs:

• You breach any of the Terms and Conditions set out herewith (including any terms found in the Privacy Policy and or any honoraria specific Terms and Conditions)
• You misuse your membership of the panel or use it for any improper purpose
• Any activities on your account(s) or your participant responses to surveys are subject to investigation in regards to data integrity, reliability and validity
• LeadPhysician rights to process and use any information necessary to run the panel is legally withdrawn, by law or otherwise.

LeadPhysician may at any time, without notice to you and in its sole discretion, amend these Terms and Conditions. Please review these Terms and Conditions periodically. Your continued use of the Website and participation in our research projects after any such amendments signifies your acceptance thereof.

These Terms and Conditions, and subsequently our Privacy Policy, constitute the entire agreement between you and LeadPhysician. This agreement shall be governed by and construed in accordance with English law.
